I do too.

Having dealt with cancer myself I thought they were being very optimistic with him making plans to come back so quickly. Even if the treatments are working it’s a long difficult process and DD would not be home. Tough situation.

loved Geronimo...

he could’ve been pretty good if he could’ve stayed healthy for more than a month at a time. I remember one of his last injuries he suffered with us resulted from stepping on his glove and tripping as he fielded a ball.

Also, who could forget him blowing a bubble while he was caught in a rundown between 3rd and home?!

There, “other positions within the organization” was code for sitting on the couch collecting a paycheck unless hired elsewhere.

Since Duncan resigned, he doesn’t get a pay check. So there is no reason for the club to say he is getting “a position within the organization” unless Duncan actually wants one.

I would imagine Dave just decided that it was in his family's long term best interests to stay home with this wife.

The fact that she is no worse now may not be the issue. This is not something anyone wants to hear I’m sure, but I have personal experience with the type of tumor Mrs Duncan has (not me but someone close to me). The long term outlook for this type of tumor is not good. No doubt the Duncans have been told this. In my opinion he is doing the absolute best thing he can do for his family right now.

In a discussion today with my best friend, who is a Cub fan,

we were jabbing at each other like always. he started in with the fact that the Cubs hold a 42 game lead in the rivalry. So I started digging and we have pretty much owned their asses for the last 70+ years. We hold a well over 100 game lead since 1930. They must’ve just beat our brains in from 1885 to about 1910 though.

StL NL franchise was a pretty sorry bunch until '26.

They did OK after that, though. If you add the American Association years it helps a bit.

doing alright.

my last vacation of 2012 is ending on a nice note. i may be relocating soon. my grandma is alive, though she’s told me several times she wants to die—sort of heartbreaking. my family was able to come in from various places across the world for the first time in a while for christmas, and that was really nice.

jury nullification is pretty strange as i understand it anyway.

don’t, when interviewing for jury selection, you have to say that you will apply the law as it exists (e.g. if someone doesn’t believe in the death penalty and they say so they are ineligible to serve on a capital case)?

therefore, if the jury nullifies, it would seem that they were lying when selected…

Tell a story.

Spell it out: imagine if you worked all your life to create a business to get your children a better life. You worked everyday to build your business. You invested you heart and soul in the business. Then, one day tragedy struck. Your business burned down in a terrible accident.

And then imagine the insurance company you’d trusted, that you’d paid year after year, knowing they’d support you when the worst happened. Then, instead of supporting you and helping you put your life back together, that company you trusted, with all their enormous resources, sent their hired “experts” in with one instruction – just to make sure that they wouldn’t have to pay a cent.

(Here, you’d put in the facts in your favor – e.g., even though the police experts (who weren’t going to profit from their determination) ruled the fire’s cause undetermined (or suspicious, as the case may be), only the insurance company says it was arson).

This is a case about trust and a case about greed. Mr. Plaintiff trusted the insurance company to do the right thing, to stand by him when he most needed them, and to help him rebuild his family business. The insurancer company, in its greed, doesn’t want to do what’s fair or what’s right. They don’t see the business mr. plaintiff built. They see one of a thousand dollar signs that all add up to one bottom line.

I hope you ladies and gentlemen of the jury have insurance, for your homes, your cars, your lives, and your health care. I know if you do, you don’t want to be another dollar sign in some insurance company’s bottom line. If you were in Mr. Plaintiff’s spot, you’d want someone you could trust. And if an insurance company broke faith with you and tried to take your money and run, you’d want someone to help you. You’d want someone to tell that insurance company, “no.” And that’s what I’m asking you to do today. Say “no” to greed. Tell the insurance company they have to stand by their customer. Tell Mr. Plaintiff that, even if he can’t trust the insurance company, he can trust YOU to protect his rights and his family.

i have thought for awhile that you might have had legal training of some kind.

however, just a little fyi that i learned today. asking the jury to sit in a party’s shoes is unequivocal grounds for a mistrial.

well, reframe it as an appeal to their common sense.

But those are the themes you’d be looking at in a conventional insurance case – the insurance company is greedy and looking for a way not to pay.

Arson is terribly hard to prove and the proof tends to be very technical. There will always be either a police or fire department investigation. They will try hard to convict anybody if they think they have a case. If you are where you are, you can contrast the government investigation with the insurance company investigation.

another problem is that the fire chief ruled it arson in this case.

there are many many many other facts i could get into, but what you’ve written covers the gist of the case. i don’t feel comfortable attacking the insurance company quite so strongly, since they are relying on the report of a (seemingly) neutral party

Assumes it was your client, rather than somebody else. Something kept your client from being indicted. While it’s certainly logically possible that someone’s responsibility for the fire could be proven to the preponderance standard but not beyond a reasonable doubt, more likely the failure to indict your client arose from some other source.

Plus, now your client is twice a victim – of the arsonist and of the insurance company.

his idea, from what I've read,

is that the central nervous system filters out information that is deemed unnecessary (by social/societal conditioning and survival instincts) so it severely limits what we can truly see and understand. He thinks that drugs – in the same way as hypnosis and genetic evolution – removes that filter.

I'm more interested in his literary works and collection of religious passages

he did a great job of drawing parallels between different religions in The Perennial Philosophy. Brave New World is one of the greatest science fiction books ever written.

I tend to read the more mystical side of science fiction, i.e. Huxley, PK Dick, Harlan Ellison, etc

Have you tried any Roger Zelazny yet?

Lord of Light is pretty interesting. I love his two Amber series, and a bunch of his other works. You might also like his short story collection, The Doors of His Face, the Lamps of his Mouth.

I love Clarke, though I've only read the Space Odyssey series

First is possibly the greatest book I’ve ever read and it pretty much goes downhill from there, though I did thoroughly enjoy them all

that said

he was a polymath and dabbled in many areas. he is one of the more well know figures in the mid-20th century… much of Huxley’s theories are really satire though. he saw Freud as the same as Ford, both are just mechanistic in nature, breaking things down into components. a bit crude to him, and probably vice versa. Huxley was much more the mystic; just both are from opposite trains of thought for the most part. since much of Huxley’s writing is from the first half of the 20th century, it’s sort of difficult to say how relevant he is today, but I’m pretty confidant in saying he was a rather influential historical figure at the very least.

This is a shame.

Dave Duncan was a fantastic pitching coach. He will definitely be missed, but I wish him and his family the best.
